Acceptance of terms

These terms and conditions govern all supply of goods and services Kahu Youth Trust ("we, "us") to you, the purchaser of goods and services from us, including your use of the website at www.kahuyouth.org ("the website") and the registration system at Class for Kids UK https://kahu-youth.class4kids.club and all programs facilitated by Kahu Youth. They are effective from 6th December 2021 and will replace all earlier Kahu Youth Trust terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

COVID-19 Safety Plan

Kahu Youth is a safe space for youth. Our COVID-19 Safety Plan provides practical ways in which Kahu Youth can actively protect ourselves and others from infection from COVID-19. This includes vulnerable youth with disabilities and youth not yet eligible for the vaccination. Kahu Youth complies with the NZ Government’s Covid Protection Framework (CPF). The framework supports us to maintain a safe environment for our youth and workers to enjoy.

Code of Conduct

By signing this document you agree that you (purchaser) and any other registered participants will act under Kahu Youth Trusts Code of Conduct which can be found at www.kahuyouth.org. If you (purchaser) and or the participant(s) are unable to comply with the Code of Conduct, and or have received warnings regarding behaviour Kahu Youth reserve the right to suspend temporarily and or remove the participant(s) from our programmes, without refund. This includes acts of violence, anyone who is found to be bullying, misbehaving or displaying disruptive behaviour. Kahu Youth obtains the right to suspend all access to our facilities and programs. 

Feedback and Complaints

Kahu Youth Trust is committed to being open and responsive to any complaints or feedback offered by youth, their families, Kahu Youth Trust team members (volunteers, contractors, workers, trustees) or by members of the community. Privacy and Confidentiality

Youth Trust understands that privacy and confidentiality are important to our community. Kahu Youth Trust abides and upholds the Privacy Act 2020 and Oranga Tamariki Act 1989. 

Unless otherwise required by law, confidential information will be treated as such and personal information will be utilised only for the purposes of providing quality support and services to youth. Personal information collected will not be disclosed to any other organisations or to any other individual without consent from the young person to whom the details relate, except where the law requires such information to be disclosed.

Liability

Kahu Youth Trust or any of their staff are not responsible for any loss or injury during any program facilitated by Kahu Youth.

You must declare all medical conditions pertaining to all participants during registration and keep us up-to-date should this change by emailing/calling us at info@kahuyouthtrust.org or 034435880.

Pricing

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.

A confirmation email and SMS will be sent to you at the email and phone number you supply when you register for a program. You are responsible for ensuring that your contact details are correct.

Payment options

All payments will be processed through a third party secured site (Stripe). They accept the following credit cards: Visa Debit, Visa, MasterCard Debit, Mastercard, Google Pay, Apple Pay, and American Express.

Under rare circumstances you may request a direct invoice. This transaction will have to be processed separately.

Credit Card Security

All payments are processed via Stripe secure payments system to ensure high levels of payment security and are subject to Stripe’s terms and conditions.

Booking Confirmation

Your booking is not confirmed until payment has been received. Paid for spaces will be given priority.

Refunds

In the rare occurrence that a program is cancelled or suspended due to COVID or another event Kahu Youth Trust will offer a full refund.

If you are not satisfied with your purchase or need to make a change in registration please cancel by contacting Kahu Youth at info@kahuyouthtrust.org. As our Holiday Programs require notice for cancellation per our vendor's requirements, the purchaser can cancel requesting a full refund within 48 hours of the registered program. If a cancellation is made within this time frame Kahu Youth will authorise a full refund within 3-5 business days. Any cancellation made after this grace period (24 hours prior to activity or day of) Kahu Youth retains the right to keep all fees paid.

We don't issue refunds for missed sessions due to your own circumstances. If there are any sessions missed due to typical bad weather, Kahu Youth will offer a make-up session, or parents will be refunded. 

Cancellation due to illness

You must refrain from bringing your child a program if they have had any form of illness within 48 hours of the program. If your child is displaying and COVID related symptoms such as high fever, difficulty breathing, cough, and cold and flu symptoms please contact us to cancel at info@kahuyouthtrust.org.

If you are cancelling after the 48 hour grace period due to a participant's illness please cancel by contacting us at info@kahuyouthtrust.org. We will review the circumstances around the child's absence and a request for a refund.

Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside

Use of the Classforkids booking website and our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of websites or supply of any services.

Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

Copyright and Trademark Notice

This site is owned Classforkids UK and operated by us. Please also refer to their terms and conditions and privacy policy regarding copyrights and trademarks. They can be found here. All materials appearing on this site, including but not limited to text, design, logos, graphics, and images may be the property of ClassforKids UK and Kahu Youth Trust. The content of this site may be used only for the purpose of registration and information. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without the express written permission of Kahu Youth Trust. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

General Conditions

We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at www.kahuyouth.org.

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified us.
